Learning objectives
The students will have to demonstrate knowledge of the international legislation concerning money laundering and anti-terrorism measures. The students must also demonstrate knowledge of the EU’s fourth money laundering directive.

The students must be able to identify the fundamental legal problems within the topics of the course.

Also, the students must acquire knowledge, skills, and competences in order to:

• Identity the relevant international legislation

• Reproduce the banks’ legal obligations and responsibilities in relation to the combating of money laundering and terrorism

• Derive the relevant rules to a bank in a given situation

• Employ legal argumentation techniques

• Formulate themselves clearly in writing and by doing so be able to bring about the legal problems and solution models related to the banks’ combating of money laundering and terrorism

• Predict the legally correct solution to a problem/case, in the way that it is expected to be settled in court

Course content and structure

Purpose:
The rules regarding the prevention of money laundering and financing of terrorism have in the later years received extensive and increasing practical and political importance. The course will provide employees of banks and their legal advisors with insights of the legal obligations and responsibilities in connection with the prevention of money laundering and the financing of terrorism. Also, the course will in particularly focus on the international legislation in relation to the prevention of money laundering and terrorism, including a specific focus on UN’s conventions regarding the prevention of organized crime and corruption, as well as the EU’s fourth money laundering directive (4AMLD).

 

Course content:
The course concerns limited liability companies within the following areas:


The international sources of law:

  • UN conventions

  • FATF Recommendations

  • EU and the European Council

  • The fourth money laundering directive

  • Case law from Court of Justice of the European Union and the European Court of Human Rights

  • Financial crimes and International private law

  • Anti-terrorism legislation

  • The international sources of law
